Channel Partner Policy for Sukunj Realty Pvt. Ltd.

Welcome to the Sukunj Realty Pvt. Ltd. Channel Partner Program. These terms and conditions outline the responsibilities, expectations, and legal obligations between Sukunj Realty Pvt. Ltd. and our Channel Partners. By signing up as a Channel Partner, you agree to comply with the policies described below.

Information We Collect:

  1. Introduction:
    • This Channel Partner Policy (“Policy”) is governed by the legal relationship between Sukunj Realty Pvt. Ltd., a company incorporated under the Companies Act, 2013, with its registered office at 95, Satellite Valley Colony, Mirjapur, Indore, Madhya Pradesh, India (hereinafter referred to as “Sukunj Realty” or “the Company”), and the Channel Partner (hereinafter referred to as “Partner”), who has registered through our official Channel Partner Network Sign-Up Form.
  2. Scope of Engagement:
    • Role and Responsibilities: As a Channel Partner, your role is to promote and sell properties listed by Sukunj Realty. You are expected to adhere to the guidelines, Standard Operating Procedures (SOPs), and marketing policies provided by Sukunj Realty.
    • Non-Exclusive Agreement: This policy does not create an exclusive relationship between Sukunj Realty and the Partner. Partners are free to pursue other business opportunities, as long as they do not conflict with Sukunj Realty’s interests or their obligations under this Policy.
  3. Eligibility and Compliance:
    • RERA Registration: A valid RERA registration number is mandatory to operate as a Channel Partner. Partners without a valid registration must obtain it within the time period specified by Sukunj Realty.
    • Legal Compliance: Partners must comply with the Real Estate (Regulation and Development) Act, 2016 (RERA) and all applicable national, state, and local laws, as well as ethical business standards.
  4. Code of Conduct:
    • Client Interaction: Professionalism, integrity, and honesty are required in all interactions with clients. Any misrepresentation of property details or services will lead to immediate disqualification from the Channel Partner Program.
    • Confidentiality: Partners are required to maintain confidentiality concerning all proprietary information, client details, and business strategies shared by Sukunj Realty.
    • Marketing Guidelines: All marketing activities must be approved by Sukunj Realty. Partners are prohibited from using misleading advertisements or unethical marketing practices.
    • Documentation and Reporting: Partners must maintain accurate records of client interactions, property visits, and transactions. Reports must be submitted to Sukunj Realty regularly, as specified in the Partner SOPs.
  5. Commission Structure:
    • Project-Based Commission: Commission rates are project-specific and will be communicated to the Partner on a per-project basis.
    • Commission Payment: Commissions will be paid within 30 days of successful transaction closure, subject to all contractual obligations being met and necessary documents submitted to Sukunj Realty.
  6. Standard Operating Procedures (SOPs):
    • Client Interaction SOP:
      • Arrange property visits at the client’s convenience.
      • Provide accurate information regarding properties.
      • Follow up with clients after visits and report the outcomes to Sukunj Realty.
    • Documentation SOP:
      • Keep a record of all client interactions and visits.
      • Submit all required documents (e.g., client visit reports) to Sukunj Realty promptly.
    • Reporting SOP:
      • Regularly update Sukunj Realty on client interactions and property visits.
      • Submit weekly or monthly reports as per the schedule provided.
    • Training SOP:
      • Attend all mandatory training sessions organized by Sukunj Realty.
      • Implement best practices discussed during training.
  7. Dispute Resolution:
    • Dispute Policy: All disputes arising from the Partner’s engagement will be attempted to be resolved amicably. If this is not possible, disputes will be referred to arbitration as per the Arbitration and Conciliation Act, 1996.
    • Jurisdiction: Any legal matters will fall under the jurisdiction of the courts in Indore, Madhya Pradesh, India.
  8. Termination:
    • Termination by Either Party: Either Sukunj Realty or the Partner can terminate this policy with a 30-day written notice, provided all contractual obligations have been met.
    • Immediate Termination: Sukunj Realty reserves the right to terminate the partnership immediately for gross misconduct, breach of contract, or violation of applicable laws.
  9. Miscellaneous
    • Amendments: Sukunj Realty reserves the right to modify these terms at any time. Any changes will be communicated in writing and must be accepted by both parties.
    • Entire Agreement: This Policy represents the full understanding between Sukunj Realty and the Partner and supersedes any previous agreements or understandings.
    • Severability: If any provision in this Policy is deemed unenforceable, the remaining provisions shall remain in effect.
